Civil rights for the minority aren't subject to a vote of the majority.  It's why we HAVE a constitution that guarantees civil rights, .  

No matter what you think of the decision, right or wrong, popular will is beside the point, just like it was in Brown v. Board and the Love case which struck down restrictions on interracial marriage. I'd have thought the constitution loving conservatives would get this, but the propagandists have told them to think a certain way, so they do.  So they mindlessly repeat that civil rights are now only as sacred as the momentary opinions of a majority of the voters who show up at the polls on a certain day.  

And FWIW, the gay, gay, gay judge was also unanimously approved.  


I get your flawed logic now. When we don't like the vote of the people, elections do not have consequences. However, when we do like the vote, then suddenly elections have consequences. So now it is a select group of liberal so called" super-intelligencia" that decides what has consequences when it comes to the vox of the people in elections. Senator McCasKill knows what is best for the hoi poli and what they mean by their vote. The voters simply get in the way of what old Claire already knows.  How convenient that we have our own little soviet Democrat Politburo in election matters that can make certain we are thinking correctly. I am highly suspicious of direct democracy. In fact, it scares me to tears. Nevertheless, when over 70% of voters send an unmistakeably clear message to their representatives and then they are insulted in a pejorative way by an elected DC political class insider with claims the people are simply to stupid to know what is good for them, you have got to start asking the hard questions about the possibility the political class in DC not only does not have a clue of the concerns of those they represent but they could care less even if they were not out of touch. I suppose we will find out in November come midterm election time if your viewpoint is valid in this case.
